These Terms of Service (the “Terms”) govern your access to and use of the website workforceember.com (the “Site”) and the human-resources, recruitment, training, and workforce-consulting services provided by Workforce Ember (“Workforce Ember”, “we”, “us”, or “our”) (the “Services”). By using the Site or engaging our Services, you agree to these Terms. If you do not agree, please do not use the Site or the Services.
1. About Our Services
Workforce Ember provides professional HR and recruitment services to businesses, including talent acquisition and recruitment, employee training and development, HR compliance and risk guidance, and performance-management consulting. We also assist candidates and job seekers in connection with recruitment. We are an HR services firm; we are not an online shop and we do not sell physical products.
2. Enquiries, Quotes, and Engagements
- Information on the Site is for general guidance and is not a binding offer. The scope, deliverables, timelines, and fees for any engagement are set out in a separate written proposal, statement of work, or agreement between you and us.
- Submitting an enquiry or contact form does not create a client relationship. A relationship begins only when we both agree an engagement in writing.
- We may decline to provide Services to any person or organisation at our discretion, including where a request is unlawful or outside our expertise.
3. Terms for Employer Clients
- You agree to provide accurate role requirements and to comply with applicable employment, equal-opportunity, and data-protection laws in your use of candidates we introduce.
- Fees, payment terms, and any replacement or rebate arrangements are governed by your engagement agreement with us.
- We take reasonable care in sourcing and screening candidates, but hiring decisions are yours. We do not guarantee that any candidate will accept a role, remain employed, or achieve any particular result.
4. Terms for Candidates and Job Seekers
- You confirm that any CV, application, or information you submit is truthful, is yours to share, and does not infringe anyone’s rights.
- Our Services to candidates are free of charge; we never ask candidates for payment to be considered for a role.
- By submitting your details you authorise us to process them and, where relevant, present them to prospective employers for roles you are considered for, as described in our Privacy Policy.
- We do not guarantee interviews, offers, or employment. Recruitment outcomes depend on employer decisions and market conditions.
5. Acceptable Use of the Site
You may use the Site for lawful purposes only. You must not use the Site in any way that is unlawful, fraudulent, or harmful, and you must not attempt to interfere with its security or proper functioning, including by hacking, scraping at scale, or distributing malware. We may suspend or terminate access for any breach of these Terms.
6. Intellectual Property
All content on the Site — including text, graphics, logos, and images — is owned by Workforce Ember or its licensors and is protected by copyright and other laws. You may not reproduce, modify, distribute, or display our content without our prior written consent, except for normal personal or internal business viewing.
7. No Professional or Legal Advice
Content on the Site, and general guidance we provide, is for information only and does not constitute legal, tax, or professional advice for your specific situation. Compliance and employment laws vary by jurisdiction; you should obtain advice tailored to your circumstances before acting.
8. Third-Party Links
The Site may link to third-party websites. We are not responsible for the content, policies, or practices of those sites, and links do not imply endorsement.
9. Disclaimers
The Site and its content are provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Site will be uninterrupted or error-free. Nothing in these Terms excludes liability that cannot be excluded under applicable law, including under the Australian Consumer Law or other mandatory consumer protections.
10. Limitation of Liability
To the fullest extent permitted by law, Workforce Ember will not be liable for indirect, incidental, special, or consequential losses, or for loss of profits, revenue, data, or goodwill, arising from your use of the Site or Services. Our total liability arising from any engagement is limited to the fees paid for that engagement, except where a higher amount is required by mandatory law.
11. Indemnity
You agree to indemnify Workforce Ember against claims, losses, and expenses arising from your breach of these Terms or your misuse of the Site or Services.
12. Governing Law
These Terms are governed by the laws applicable at our principal place of business, without regard to conflict-of-law rules, and subject to any mandatory consumer-protection laws of your country of residence. Disputes will be handled through good-faith discussion first; unresolved disputes are subject to the competent courts of that jurisdiction.
13. Changes to these Terms
We may update these Terms from time to time. The “Last updated” date reflects the most recent revision. Continued use of the Site after changes constitutes acceptance of the revised Terms.
